David Lustbader was born in Newark, New Jersey.

His first job was in the claims department of a casualty insurance company.

He is Certified by the New Jersey Supreme Court as a Civil Trial Attorney. He is AV rated by Martindale-Hubbell. He is in the Bar Register of Preeminent Lawyers (Martindale-Hubbell). He is a member of the Essex County Bar Association, New Jersey Bar Association (life member) and New Jersey Defense Association.

He received a Bachelor's Degree from Grinnell College, Grinnell, Iowa.

He received a Juris Doctor from George Washington University, Washington, D.C.

In addition to primarily trying cases, he has been appointed an arbitrator multiple times and presented numerous risk management seminars to medical/dental audiences.
